Welcome to FleetOS (operated by Human Singularity). By accessing or using our web dashboard, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Use of the Service
FleetOS provides cloud-based fleet management, GPS tracking, dispatching, and payroll calculation tools. You agree to use the Service only for lawful business purposes. You are strictly prohibited from using the Service to track individuals without their explicit, legally obtained consent.
2. Limitation of Liability and "As-Is" Disclaimer
- Software "As-Is": The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Human Singularity explicitly disclaims any warranties of merchantability, fitness for a particular purpose, or non-infringement.
- GPS and Mapping Accuracy: We do not guarantee the absolute accuracy, completeness, or timeliness of GPS tracking, mapping data, or location-based services. FleetOS relies on third-party hardware (smartphones) and networks which may fail or provide inaccurate data.
- Payroll and Financial Calculations: FleetOS provides payroll calculation tools for your convenience. You are solely responsible for reviewing, verifying, and confirming all payroll, tax, and financial calculations generated by the Service before issuing real payments. Human Singularity is not liable for any financial losses, underpayments, overpayments, or tax penalties resulting from software bugs, inaccurate data entry, or calculation errors.
- Maximum Liability: To the maximum extent permitted by law, Human Singularity and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. In no event shall our total liability to you exceed the amount you paid us in the past twelve (12) months.
3. Subscription, Billing, and Right to Modify Pricing
- Payment: You agree to pay all fees associated with your chosen subscription plan.
- Right to Modify Pricing: We reserve the right to change our subscription fees, introduce new charges, or modify our pricing models at any time. We will provide you with reasonable advance notice of any pricing changes. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the modified amount.
- Non-Payment: We reserve the right to suspend or terminate your account if your payment method fails or if your account falls into arrears.
4. User Data and Ownership
You retain ownership of the data you input into the Service. However, you grant us a worldwide, royalty-free license to host, store, use, and process your data solely for the purpose of providing and improving the Service.
5. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, particularly in cases of suspected abuse, illegal activity, or violation of these Terms.
6. Indemnification
You agree to indemnify, defend, and hold harmless Human Singularity, its founders, and employees from any claims, damages, lawsuits, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights (including employee privacy rights regarding GPS tracking).
7. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or a notification within the dashboard. Continued use of the Service constitutes acceptance of the new Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws of your jurisdiction, without regard to its conflict of law principles.
